1. Agreement
By downloading, installing, and/or using FlightDeck ("App"), you ("End User") agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree to these terms, do not use the App. This EULA is between you and Ident Aviation LLC ("Ident Aviation" or "Licensor"), not Apple Inc. Ident Aviation ("Licensor") is solely responsible for the App and its content.
2. License Grant
Ident Aviation grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. The App is licensed, not sold. All ungranted rights are reserved.
3. Aviation Disclaimer
⚠️ IMPORTANT — PLEASE READ CAREFULLY
- FlightDeck is a training and reference tool only. It is NOT a certified flight planning system and is NOT approved for use as a primary source of aviation information.
- All calculations (density altitude, weight & balance, fuel planning, wind correction, climb, descent, diversion, unit conversion, etc.), personal minimums checks, and "Can I fly?" assessments are provided for educational and reference purposes only.
- Pilots/End Users are solely responsible for verifying all calculations against the aircraft's Pilot Operating Handbook (POH), approved performance charts, and official FAA/aviation authority publications. The App does not replace pilot judgment, required training, any aircraft's current and approved flight manual, or POH.
- Weather data (METAR/TAF), NOTAMs, and TFR information are sourced from third-party providers and may be delayed, incomplete, or inaccurate. Always obtain an official weather briefing and check current NOTAMs and TFRs through official sources before flight.
- You are responsible for operation of any aircraft. Never use the App as the sole or primary basis for any safety-critical decision. Do not rely solely on this App for any flight planning or in-flight decisions. See Section 8 for Limitation of Liability.
4. Restrictions
As End User you agree not to:
- Use the App as a primary or sole source for any real-world flight planning or navigation;
- Modify, reverse engineer, decompile, or disassemble the App;
- Redistribute, sublicense, rent, lease, or lend the App to third parties;
- Use the App for any unlawful purpose or in violation of any applicable aviation regulations;
- Bypass security, authentication, access controls, or technical restrictions;
- Violate any state law, federal law, municipal law, aviation regulations, privacy, intellectual property or other rights;
- Remove or alter any proprietary notices, labels, or marks on the App.
5. Intellectual Property
The App and all related content, features, and functionality (including but not limited to design, code, graphics, and user interface) are owned by Ident Aviation and are protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you, as End User, any ownership rights in the App.
6. Account, Purchases, and Data
You may create an account to save your pilot profile, photos, and preferences. You are responsible for maintaining the confidentiality of your account credentials.
Certain features (Flight Tools and Study Tools) are available as optional one-time in-app purchases processed by Apple through the App Store. These are not subscriptions and do not renew. Purchases are tied to your Apple ID, not your FlightDeck account; if you reinstall the App or use a new device, use "Restore Purchases" in the App to restore them. Refund requests are handled by Apple under its policies.
You may delete your account at any time through the App, which will permanently remove your associated personal data from our servers within a reasonable time, except where retention is required by law.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW THE APP AND ALL DATA, CALCULATIONS, CONTENT, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. IDENT AVIATION DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IDENT AVIATION, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF PROFITS, OR ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP, EVEN IF IDENT AVIATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES RESULTING FROM RELIANCE ON ANY CALCULATIONS, DATA, OR INFORMATION PROVIDED BY THE APP FOR AVIATION OR ANY OTHER PURPOSE.
9. Apple-Specific Terms
- Apple has no obligation to furnish any maintenance and support services with respect to the App.
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App. Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection laws.
- Apple and its subsidiaries are third-party beneficiaries of this EULA.
10. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically if you fail to comply with any of its terms. Upon termination, you agree that you shall cease all use of the App and delete all copies from your devices. Ident Aviation may suspend or terminate access for a material or repeated breach, safety or security risk, legal necessity, or for any reason deemed necessary by Ident Aviation. Termination by Ident Aviation is solely in the discretion of Ident Aviation. All decisions regarding termination by Ident Aviation are final.
11. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the United States and the State of Rhode Island, without regard to conflict of law principles.

13. General
This Agreement and the Privacy Policy are the entire agreement about the App, except feature- or purchase-specific terms. Unenforceable provisions will be enforced to the lawful maximum and severed without affecting the rest. Waivers must be written. You may not assign this Agreement without consent; we may assign it in a merger, reorganization, asset sale, or by operation of law, subject to law.
